WAVESSO TERMS OF SERVICE

1. About these Terms
These Terms of Service (“Terms”) govern access to and use of Wavesso, a web-based digital service available at https://wavesso.com (“Wavesso”, the “App” or the “Service”).

a sole proprietorship registered in the Polish Central Register and Information on Economic Activity (“Service Provider”, “we”, “us” or “our”).
These Terms are available at https://wavesso.com/terms. Our processing of personal data is described in the Privacy Policy at https://wavesso.com/privacy.
2. Definitions
Account means an individual account used to access Wavesso.
User means any person or entity accessing or using the Service.
Consumer means an individual using or purchasing the Service primarily for purposes outside that person's trade, business or profession.
Free Plan means a version of the Service offered without a recurring monetary subscription fee and which may contain usage or feature limitations.
Paid Plan means a paid version of the Service providing features and usage limits described before purchase.
Subscription means paid access to a Paid Plan for a billing period, which may automatically renew.
Forecast means information, calculations or predictions concerning waves, swell, wave height, wave period, wave direction, wind, weather or other marine conditions.
Surf Spot means a location presented by Wavesso in connection with surfing or another water activity.
Third-Party Provider means an independent provider of data, infrastructure, APIs, authentication, payments or other services used by Wavesso.
3. The Service
Wavesso is an informational and planning tool intended primarily for people interested in surfing. Depending on current functionality, it may allow Users to discover Surf Spots, monitor selected locations, analyse Forecasts, define preferred conditions, receive alerts, plan surfing trips and access supporting information about locations, airports, transport or travel.
Features, usage limits and availability may differ between Plans. Current Paid Plan features, prices and limits will be displayed before purchase.
4. Technical requirements and online risks
To use Wavesso you generally need an Internet-connected device, a reasonably current web browser, JavaScript and any technically necessary cookies or similar technologies.
Certain functions may allow you to enter an address, city, town or other approximate location as a starting point for a calculation. Wavesso does not track your live device location in the background.
Using online services involves ordinary Internet-related risks, including phishing, malicious software, credential theft and unauthorised Account access. You are responsible for maintaining reasonable security of your device and Account credentials.
5. Accounts and formation of the agreement
An agreement to use Account-based Wavesso services is concluded when you successfully create an Account after accepting these Terms.
Accounts may be created using an email address or a supported third-party authentication service, including Google. You must provide accurate information and keep Account information reasonably current.
You are responsible for the confidentiality and security of your Account credentials. An Account is generally intended for one User.
You may stop using Wavesso and request Account deletion at any time by contacting [email protected]. Deleting an Account is separate from exercising any statutory right to withdraw from a Paid Plan and does not automatically create a right to a refund unless applicable law requires one.
6. Acceptable use
You may use Wavesso only in accordance with applicable law, these Terms and the intended purpose of the Service.
You must not provide unlawful content, attempt unauthorised access, bypass security or Plan limits, systematically scrape data without permission, use unauthorised bots, disrupt or overload infrastructure, resell access without permission, or use Wavesso data to build an unauthorised copy or competing database or service in violation of our or third-party rights.
We may apply reasonable rate limits and technical restrictions to protect security, stability and Plan limits.
7. Surf forecasts and safety
Wavesso is an informational and planning tool. It is not a safety service.
Forecasts may be generated using mathematical models, meteorological or oceanographic data and information obtained from independent Third-Party Providers. A Forecast is a prediction, not a guarantee of actual conditions.
Actual ocean, marine and weather conditions may differ materially from information displayed by Wavesso. We do not guarantee Forecast accuracy, any particular wave or wind condition, that a Surf Spot is safe, or that predicted conditions are suitable for a particular User.
A classification suggesting that conditions may be suitable for a skill level does not mean those conditions are safe for every User.
Information provided by Wavesso is not a lifeguard instruction, professional safety assessment, official marine warning or guarantee that entering the water is safe.
Before entering the water, you should independently assess actual local conditions and appropriate local warnings. You are responsible for considering your surfing ability, physical condition, equipment, currents, tides, wave and wind conditions, seabed and entry conditions, obstacles, other water users and local rules.
Surfing and other ocean activities involve risks that may include serious injury or death. The final decision whether to enter the water is always yours.
Notifications sent by Wavesso are not emergency or safety alerts and must not be relied upon as a safety notification system.
Nothing in this section excludes or limits liability where prohibited by applicable law.
8. Third-party data and services
Some information displayed by Wavesso may originate from Third-Party Providers. A Third-Party Provider may change, delay, interrupt or discontinue its data or services independently of us.
Wavesso may contain links or redirects to third-party websites and services. If you enter into a contract directly with a third party, that third party's terms govern its service.
Unless expressly stated otherwise, Wavesso is not an airline, carrier, travel agency or package travel organiser.
9. Free Plans, Paid Plans and Subscriptions
Wavesso may offer Free and Paid Plans. Before purchasing a Paid Plan, you will be shown the price and currency, billing period, functionality, applicable limits, renewal terms and cancellation terms.
Where a Subscription is identified as automatically renewing, it will renew for successive billing periods unless automatic renewal is cancelled. You may disable renewal through the method provided in your Account or billing interface.
Ordinary cancellation generally prevents the next renewal while allowing access until the end of the already-paid billing period.
Payments may be processed by a Third-Party Provider, including Stripe. Where card information is submitted directly to the payment provider, Wavesso does not store the complete payment card number.
If payment fails, we may retry payment, restrict Paid Plan features or move the Account to a Free Plan.
Cancelling automatic renewal and exercising a statutory right of withdrawal are separate actions.
10. Consumer right of withdrawal
If you are a Consumer who purchases a Paid Plan remotely, you may have a statutory right to withdraw from that agreement.
For Consumers covered by Polish or applicable European Union consumer law, this will generally include a 14-day withdrawal period beginning on the date the agreement is concluded, subject to statutory exceptions.

You may use the model form at the end of these Terms, but this is not mandatory.
Where applicable law requires an online withdrawal function, Wavesso will provide it.
If you expressly request that a paid service begin before the withdrawal period expires, the legal consequences of a later withdrawal will be determined by applicable law.
Nothing in these Terms limits broader mandatory withdrawal rights.
11. Conformity of the digital service
Where mandatory consumer legislation applies, we are responsible for providing Wavesso in conformity with the agreement.
If the Service fails to conform, a Consumer may request that it be brought into conformity and may have additional rights, including a price reduction or termination, where statutory conditions are met.
Nothing in these Terms restricts mandatory consumer remedies.
12. Complaints
Complaints may be submitted to [email protected] or by post to the Service Provider's address above. For matters requiring prompt contact, you may call +48 572 848 969.
To help us investigate, you may include your Account email, a description of the issue, when it occurred and the resolution requested. Failure to provide these details does not automatically invalidate a Consumer complaint.
Consumer complaints will be handled within the period required by applicable law.
13. Availability, maintenance and updates
We use reasonable efforts to maintain Wavesso. The Service may temporarily be unavailable due to maintenance, updates, failures, Third-Party Provider issues, security incidents, Internet infrastructure failures or circumstances outside our reasonable control.
Unless expressly agreed separately, Wavesso does not provide a guaranteed service level or 100% uninterrupted availability. Mandatory Consumer rights remain unaffected.
14. Changes to Wavesso
We may modify Wavesso for legitimate reasons including introducing or improving features, maintaining security, complying with law, adapting to technology, responding to Third-Party Provider changes, preventing abuse or removing obsolete functionality.
Changes to digital services supplied continuously to Consumers will be made subject to applicable consumer law. Where a change materially and negatively affects a Consumer's access or use, we will provide any notice and rights required by law.
15. Price and Subscription changes
Price changes may apply to future purchases and Subscription renewals. The price applicable to a new purchase will be shown before the agreement is concluded.
Changes affecting an existing Consumer Subscription will be made in accordance with applicable consumer law. Where express agreement to a new price is legally required, silence, inactivity or continued use alone will not substitute for that consent.
16. Intellectual property
Wavesso and its components, including software, interface design, branding, graphics, text, database structures and original methods of presenting information, may be protected by intellectual property and database rights.
Subject to these Terms, you receive a limited, non-exclusive and non-transferable right to use Wavesso for its intended purpose. No ownership of Wavesso or its source code is transferred to you.
17. Liability
We are responsible for the Service to the extent required by applicable law.
If you are a Consumer, nothing in these Terms excludes or limits liability or statutory rights that cannot lawfully be excluded or limited.
For Users acting exclusively for business or professional purposes and not entitled to mandatory consumer protection, to the maximum extent permitted by law, we will not be liable for indirect or consequential losses or lost profits, and our aggregate liability arising from a Paid Service will not exceed the fees actually paid by that User during the six months immediately preceding the event giving rise to the claim.
18. Suspension and termination
You may stop using Wavesso at any time.
We may temporarily restrict or suspend access where reasonably necessary because of security concerns, suspected unauthorised access, serious or repeated violations, attempts to circumvent Plan restrictions, unpaid Subscription fees or a legal requirement.
Where appropriate, we may provide an opportunity to remedy a breach before permanent termination. Mandatory Consumer rights remain unaffected.
19. Changes to these Terms
We may amend these Terms for legitimate reasons, including changes in law, functionality, technology, security, payment arrangements or Third-Party Providers.
Registered Users will receive reasonable advance notice of material changes where required. Changes will not deprive Consumers of acquired rights.
Where applicable law requires express consent to a contractual change, continued use or silence will not substitute for that consent.
20. Privacy
Our processing of personal data is described in the Privacy Policy at https://wavesso.com/privacy.
Acceptance of these Terms does not constitute consent to direct marketing where separate consent is required.
21. Minors
Wavesso may be used by individuals who have not yet reached the age of majority, subject to applicable legal requirements.
Where applicable law requires the consent or involvement of a parent or legal guardian to create an Account, enter into an agreement, purchase a Paid Plan or perform another action, a minor may do so only with the required consent or involvement.
Users aged 13 or older who have not reached the age of majority should obtain parental or guardian consent to the extent required by applicable law.
For Users under 13, creating an Account or providing personal information may require the direct involvement and appropriately verified consent of a parent or legal guardian. Where Wavesso does not provide a mechanism capable of obtaining such consent in accordance with applicable law, a person under 13 should not independently create an Account.
Purchasing a Paid Plan as a minor may require the consent or action of a parent or legal guardian in accordance with the law applicable to that User.
Parents and legal guardians may contact [email protected] regarding an Account used by a person under their care.
Wavesso does not replace adult supervision or professional surfing instruction.
22. Alternative dispute resolution
Consumers may use out-of-court dispute resolution mechanisms available under applicable law. Consumers in Poland may obtain information about ADR from the Polish Office of Competition and Consumer Protection and competent consumer ADR bodies. Consumers elsewhere may use applicable national ADR mechanisms.
23. Governing law and jurisdiction
These Terms and agreements concluded with us are governed by the laws of Poland.
If you are a Consumer, this choice of law does not deprive you of mandatory protections provided by the law of your country of habitual residence where those protections apply.
For Consumers, jurisdiction is determined by applicable mandatory law. For Users acting exclusively in a business or professional capacity and not entitled to mandatory consumer protection, disputes will be subject to the courts having jurisdiction over the Service Provider's place of business unless mandatory law provides otherwise.
24. Language versions
These Terms may be made available in Polish and English. The Polish version is the primary version, without prejudice to mandatory Consumer protections.
25. General provisions
These Terms are effective from 24 August 2026.
If any provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Failure by us to enforce a right does not constitute a waiver of that right.
